Burnet County Man Sentenced with Aggravated Sexual Assault of a Child After 29 Years

On Friday, May 23, 2025, Judge Allan Garrett of the 33rd District Court followed the recommendation of a Burnet County jury and sentenced Roy Lee Guerrero a resident of Burnet County, Texas, aged 70, to 29 years and four months in prison following his conviction for the offense of Aggravated Sexual Assault of a Child. The case was prosecuted by Bill Price and Peter Keim for the office of District Attorney Perry Thomas.

The evidence showed that Guerrero sexually abused his step-daughter on the way home from a Super Bowl Party in 1996. The victim, who was 12 years old at the time, reported the abuse to a friend, whose mother notified officials at Marble Falls Middle School. However, law enforcement was not notified until the victim disclosed the abuse to her husband in 2022.

Investigators with the Burnet County Sheriff’s Office learned of several other women who had been sexually abused by Guerrero over the years, both as children and as adults. Those women all testified at trial. The jury also heard from Guerrero’s wife, Guerrero’s other stepdaughter, and Guerrero himself, who each corroborated portions of the victim’s testimony. Despite the age of the case and the lack of corroborating physical evidence, the jury was able to reach a guilty verdict based on the witnesses’ testimony. At the punishment phase of trial, prosecutors presented evidence that Guerrero had also sexually assaulted his sister-in-law in Corpus Christi in 1995, just before he fled to Burnet County.
